1. Who we are
Digital King Inc. (“Digital King,” “we,” “us,” or “our”) is a marketing agency organized under the laws of New Jersey and headquartered in Lakewood, New Jersey. This Privacy Policy (“Policy”) explains how we collect, use, store, share, and protect personal information (“Personal Information”) when you visit digitalkinginc.com (the “Site”), submit an inquiry, engage us for services, receive SMS or email communications from us, or otherwise interact with us. By using the Site or interacting with us, you acknowledge that you have read and understood this Policy.
2. Scope of this policy
This Policy applies to Personal Information collected by Digital King through the Site, our inquiry forms, email correspondence, scheduled calls, SMS and voice communications, and during the course of delivering services to clients. Separate data processing addenda may apply to Personal Information we process on behalf of a client under a signed master services agreement or data processing agreement; those agreements, where executed, govern processing of client end-user data and take precedence over this Policy for that processing.
This Policy does not apply to information handled by third parties that we link to or that you visit through our Site. Their privacy practices are governed by their own policies.
3. Information we collect
Information you provide directly
When you submit a contact form, request an audit, reply to an email, schedule a call, subscribe to communications, or correspond with us, you may provide: full name; business name; job title; email address; telephone number; mailing address; website URL; revenue range, team size, and other business context; budget and scope preferences; content or notes you supply about your operation; and any other information you choose to send us.
Information collected automatically
When you visit the Site, our servers and third-party analytics tools automatically collect technical information including: IP address; browser type and version; operating system; device type and identifiers; referring URL; pages viewed, time spent, and click paths; approximate geographic location derived from IP; and language preference. We use cookies, pixels, web beacons, local storage, and similar technologies to collect some of this information. See Section 7 for details on cookies and tracking.
Information received from third parties
We may receive Personal Information from third parties including advertising platforms (Google, Meta, TikTok, LinkedIn, and others), CRM and email platforms (GoHighLevel, HubSpot, Klaviyo, and others), call-tracking providers (CallRail and others), attribution and analytics providers (Google Analytics 4, Looker Studio, Segment, and others), enrichment vendors, and professional references you authorize. The types of information and the purposes for which it is received depend on the third party and the service.
Information from messaging and calls
If you communicate with us by SMS, phone, or recorded voice, we may record, transcribe, and retain the contents, call metadata (phone numbers, timestamps, duration), and derived analytics. We will disclose call recording at the time of the call where required by law. Inbound SMS from you may be logged in our systems along with the sending phone number and the message content.
4. How we use Personal Information
We use Personal Information to: (a) respond to your inquiries and deliver the services you request; (b) provide, operate, maintain, secure, and improve the Site and our services; (c) personalize your experience and tailor content, offers, and communications; (d) send marketing, educational, and service communications by email, SMS, phone, or mail, in accordance with your consent and applicable law; (e) run our own marketing campaigns, including remarketing and audience matching through advertising platforms; (f) conduct research, analytics, benchmarking, product development, and case-study drafting; (g) exercise and defend our legal rights, including responding to subpoenas, court orders, and regulatory inquiries; (h) comply with applicable law, including tax, accounting, audit, and anti-fraud obligations; (i) evaluate prospective business relationships and perform due diligence; (j) detect, investigate, and prevent security incidents, fraud, abuse, and violations of our terms; and (k) any other purpose described to you at the time of collection or for which you give consent.
Our legal bases for processing (where GDPR, UK GDPR, or similar laws apply) include: your consent; performance of a contract; compliance with a legal obligation; and our legitimate interests in operating our business, protecting our property and rights, and marketing our services.
5. SMS, text message, and A2P 10DLC disclosures
Digital King may send SMS or MMS messages to phone numbers you provide to us. By providing your phone number and opting in through a Site form, a scheduled call, or another express affirmative action, you consent to receive SMS messages from Digital King related to your inquiry, any engagement we enter into, account or service updates, and ongoing marketing communications until you opt out.
Message frequency varies based on your interaction with us and is not guaranteed. Message and data rates may apply from your wireless carrier. Digital King does not charge for messages, but your carrier may. Digital King does not share SMS opt-in data or phone numbers with third parties or affiliates for marketing purposes. Phone numbers collected for SMS are used solely to deliver the messages described above and to operate our services.
To stop receiving SMS messages from us, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message. You will receive a final confirmation message and no further marketing SMS from that campaign. For help, reply HELP to any message or email info@digitalkinginc.com. Opting out of SMS does not opt you out of transactional emails, phone calls, or other communications unless you request that separately.
Digital King complies with the Telephone Consumer Protection Act (TCPA), the FCC’s implementing rules, the CTIA Messaging Principles and Best Practices, and the A2P 10DLC registration requirements administered by The Campaign Registry and the mobile carriers. Carriers may apply spam filtering and message throughput limits outside our control. Digital King is not responsible for undelivered, delayed, misrouted, or filtered messages. Digital King is not liable for any wireless carrier’s charges, policies, coverage gaps, or service interruptions.
If you are acting on behalf of an organization, you represent that you have authority to provide the phone number and consent on behalf of the subscriber or organization whose number you are providing.
6. Email communications
By providing your email address, you consent to receive transactional emails (for example, replies to your inquiry, audit deliveries, engagement updates, and account notices) and, unless you opt out, marketing emails from Digital King. Marketing emails include an unsubscribe link. Transactional emails tied to an active engagement, legal notice, or compliance obligation may continue regardless of marketing preferences.
7. Cookies and tracking technologies
The Site uses cookies, pixels, web beacons, software development kits, local storage, and similar technologies (together, “Tracking Technologies”) to operate, secure, analyze, and market the Site. Tracking Technologies on the Site may include but are not limited to: Google Analytics 4, Google Tag Manager (client-side and server-side), Google Ads conversion tracking, Meta Pixel and Conversions API, LinkedIn Insight Tag, Microsoft Clarity, Hotjar, and session replay tools. These may be used to understand usage, measure ad performance, deliver remarketing, and build audiences.
Most browsers allow you to refuse or delete cookies. Doing so may affect functionality. We honor opt-out signals to the extent required by applicable law, including Global Privacy Control (GPC) signals where legally recognized. You may control interest-based advertising through the Digital Advertising Alliance (optout.aboutads.info), Network Advertising Initiative (optout.networkadvertising.org), and the European Interactive Digital Advertising Alliance (youronlinechoices.eu).
8. How we share Personal Information
We do not sell Personal Information for monetary consideration. We share Personal Information only as follows:
Service providers and processors. We share Personal Information with vendors who provide technology, infrastructure, analytics, CRM, email and SMS delivery, call tracking, advertising, cloud hosting, payment processing, customer support, and professional services on our behalf, under written contracts that limit their use of Personal Information to services they provide to us.
Advertising and analytics partners. We share hashed or de-identified data with advertising and analytics platforms (Google, Meta, TikTok, LinkedIn, and others) to measure and optimize advertising, build lookalike audiences, and perform attribution. Where required, this is done on the basis of your consent.
Legal, safety, and fraud. We may disclose Personal Information to law enforcement, regulators, courts, or private parties when required by law, subpoena, court order, or to protect the rights, safety, property, or integrity of Digital King, our clients, or third parties.
Business transfers. If Digital King is involved in a merger, acquisition, reorganization, financing, sale of assets, bankruptcy, or similar transaction, Personal Information may be transferred to a successor or affiliate as part of that transaction.
With your consent or direction. We share Personal Information with other third parties when you instruct us to or otherwise consent.
De-identified or aggregated data. We may share de-identified, aggregated, or anonymized information that does not reasonably identify an individual for any business purpose.
9. Data retention
We retain Personal Information only as long as necessary for the purposes described in this Policy, to comply with legal and tax obligations, to resolve disputes, and to enforce our agreements. Inquiry and prospect data is retained for up to 24 months after the last interaction unless a business relationship develops. Client engagement records are retained for up to 7 years after engagement close, or longer where required by law. Automated deletion and de-identification schedules are applied where operationally feasible.
10. Data security
We use reasonable administrative, technical, and physical safeguards designed to protect Personal Information from unauthorized access, disclosure, alteration, and destruction. These include encryption in transit, access controls, least-privilege provisioning, vendor reviews, and incident response procedures. No security program is perfect and no system is impenetrable. We do not guarantee absolute security and disclaim liability for security incidents outside our reasonable control, including zero-day vulnerabilities, carrier or cloud-provider breaches, and user-side compromises.
11. International data transfers
Digital King is based in the United States and processes Personal Information in the United States. If you access the Site or correspond with us from outside the United States, your Personal Information will be transferred to, stored in, and processed in the United States and potentially other jurisdictions where our service providers operate. Where required, we rely on approved transfer mechanisms such as Standard Contractual Clauses, the EU-US Data Privacy Framework (where applicable), and equivalent safeguards.
12. Your privacy rights
US state privacy rights
Depending on your state of residence (including but not limited to California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia), you may have rights to: (i) know or access the Personal Information we hold about you; (ii) correct inaccurate Personal Information; (iii) delete Personal Information; (iv) obtain a portable copy of Personal Information; (v) opt out of “sale” or “sharing” of Personal Information (which we do not engage in as defined by those laws); (vi) opt out of profiling for decisions with legal or similarly significant effects; (vii) limit use of sensitive Personal Information (which we do not materially use); and (viii) not be retaliated against for exercising your rights.
California residents (CCPA / CPRA)
Over the preceding 12 months, we have collected the categories of Personal Information described in Section 3 for the purposes described in Section 4 and shared them with the categories of recipients described in Section 8. We do not “sell” Personal Information for monetary consideration. Depending on whether certain advertising cookie activity qualifies as “sharing” for cross-context behavioral advertising, you may exercise your right to opt out via the cookie settings on the Site or by emailing info@digitalkinginc.com.
EEA, UK, and Swiss residents
You have the rights described by the GDPR and UK GDPR, including access, rectification, erasure, restriction, portability, objection, and withdrawal of consent, and to lodge a complaint with a supervisory authority. The controller for processing described in this Policy is Digital King Inc.
How to exercise your rights
Submit a request by emailing info@digitalkinginc.com with the subject line “Privacy Request.” We will verify your identity before acting on your request, typically by matching identifiers to records already in our system. We will respond within the timeframes required by applicable law. If we deny a request, you may appeal by replying to our response. You may also designate an authorized agent to submit a request on your behalf, subject to reasonable verification.
Data deletion requests
To request deletion of your Personal Information — including any information associated with our use of third-party platform integrations such as Meta (Facebook and Instagram) tools and APIs — email info@digitalkinginc.com with the subject line “Data Deletion Request.” Include the name, email address, or phone number associated with the records you want deleted. We will confirm receipt, verify your identity, delete the Personal Information we are not legally required to retain, and confirm completion, within the timeframes required by applicable law.
13. Children’s privacy
The Site and our services are directed to businesses and adult decision-makers. We do not knowingly collect Personal Information from children under 16 (or the age specified by your jurisdiction). If we learn that we have collected Personal Information from a child in violation of this Policy, we will delete it. A parent or guardian who believes we have collected such information may contact info@digitalkinginc.com.
14. Do Not Track
Some browsers offer a “Do Not Track” setting. There is no finalized industry standard for responding to DNT signals at this time, and we do not currently respond to DNT signals. Where recognized by law (for example, California’s recognition of Global Privacy Control), we honor opt-out preference signals.
15. Third-party links, integrations, and services
The Site may link to or integrate with third-party services that are not operated by Digital King. This Policy does not cover the practices of those third parties. We are not responsible for the content, policies, security, availability, or practices of any third party. Your use of any third-party service is at your own risk and is governed by that third party’s terms and privacy policy.
16. Illustrative content notice
Some content on the Site, including case study snapshots, client names, client testimonials, engagement descriptions, benchmark ranges, team member profiles, and illustrative metrics, may be fictional, anonymized, composite, or directional and is intended for general informational purposes only. See our Terms of Service for the full illustrative-content disclaimer. Nothing on the Site is a representation that a specific outcome, statistic, or result is attributable to a real, identifiable engagement or will be achievable for you.
17. Changes to this policy
We may update this Policy from time to time. When we do, we will revise the “Last updated” date. Material changes will be highlighted on this page or communicated through other reasonable means. Your continued use of the Site or our services after the effective date of a change constitutes acceptance of the revised Policy.
